What To Do After An Arrest In Los Angeles

The hours after an arrest matter. A few careful decisions can protect your rights — and your future.

An arrest is disorienting, but the decisions you make in the first hours can shape everything that follows. The most important thing is to stay calm and avoid actions that give the prosecution more to work with.

You have the right to remain silent, and you should use it. Beyond basic identifying information, you are not required to answer questions or explain your side of the story. Politely state that you wish to remain silent and that you want a lawyer.

Ask for an attorney clearly and early. Once you request counsel, questioning should stop. Do not try to talk your way out of the situation — well-meaning explanations are frequently used against the person who gave them.

Do not discuss your case with anyone other than your attorney — not officers, not others in custody, and not over recorded jail phone lines. Assume every conversation may be heard.

As soon as you are able, write down everything you remember: the time and place, what was said, the names or badge numbers of officers, and any witnesses. Small details fade quickly and can matter a great deal later.

Then contact a defense attorney. Early involvement often creates the most options — sometimes before charges are even filed.
